The Order pausing residential evictions occurred yesterday, January 14, 2021. There have been numerous questions coming from both landlords and tenants. We will try to address some of the main questions below.
Q. WILL MY SCHEDULED EVICTION HEARING AT THE LANDLORD AND TENANT BOARD (LTB) PROCEED? A. The Landlord and Tenant Board will continue to hear eviction applications and issue orders, but the enforcement of eviction orders will be postponed for the duration of the emergency order, except in urgent situations – such as for illegal activity. This includes orders issued, but not carried out, before the emergency order came into effect. (Quick Facts: News.Ontario.ca)
Q. HOW LONG IS THIS PAUSE ON EVICTIONS EXPECTED TO LAST? A. The Order issued under the Emergency Management and Civil Protection Act, stipulates that the order will be revoked on January 27, 2021, unless it is extended. The pause is therefore expected to last for two weeks. This is of course unless the date is changed for a date further in the future.
Q. CAN I STILL FILE AN EVICTION APPLICATION DURING THE PAUSE ON EVICTIONS? A. Yes. The Landlord and Tenant Board will continue to receive these applications.
Q. I WAS ALREADY ISSUED AN EVICTION ORDER AND INTEND TO MOVE. CAN I STILL MOVE OUT?
A. Yes. Ontario’s Stay-At Home Order, stipulates that moving residences is one of the exceptions to the requirement that every individual shall remain in their place of residence at all times. The pause on residential evictions does not affect this situation.
